Separate Criminal Court & DMV Proceedings in Salinas
A DUI with aggravating factors can lead to two separate proceedings. The criminal case may be heard in Monterey County Superior Court, including the Salinas Courthouse. The California DMV Administrative Per Se process addresses driving privileges and can proceed independently of the criminal case.
You generally have 10 days after receiving a suspension or revocation order to request a DMV hearing. The hearing may examine the legal basis for the stop or arrest, the chemical-test result, and whether a refusal occurred. It doesn’t determine criminal guilt, and the criminal court schedule doesn’t pause the DMV deadline.
Evidence That Can Shape an Enhanced DUI Case
The underlying allegation and each claimed enhancement require a separate factual review. Police reports, citations, DMV documents, test records, video, medical information, and court paperwork may address different parts of the prosecution’s case.
Important questions may include:
- Traffic stop and arrest: What facts allegedly justified the stop, detention, and arrest?
- Driving observations: Is the officer’s account consistent with video, witness information, or other available evidence?
- Field sobriety testing: Which tests were used, how were they administered, and how were the results documented?
- Chemical testing: When was the sample collected, which testing method was used, and what calibration or maintenance records exist?
- BAC timing: Does the reported result reliably reflect the alleged BAC at the time of driving rather than only at the time of testing?
- Prior convictions: Do the identity, date, offense, and disposition support the prior-offense allegation?
- Passenger allegation: Was the passenger under 14, and was the enhancement properly charged under Vehicle Code section 23572?
- Injury and causation: What injury is claimed, and can the prosecution connect it to the alleged driving conduct?
The answers can affect decisions about motions, negotiations, sentencing issues, and whether the case proceeds to trial.

"I had the best experience!"Mr. Scott represented me in my divorce action. It was a difficult time in my life and dealing with the custody of my children and support issues, Mr. Scott and his team really came through for me. He was aggressive when he needed to be but was able to settle all of my issues outside of the courtroom. I met with other attorneys before I met with Mr. Scott.
